General Terms

The following conditions have been created based on the specific needs and nature of the Kairi Carine Saarts website (Happy Happy OÜ, reg. no. 16101387, not liable to VAT), hereinafter referred to as "the website" or "the Gallery" or "e-shop" and govern the use of the offerings on the website.

These Terms establish an agreement between the website owner and its users, detailing our terms and conditions. By accessing or using the website, booking a show via email, or placing an order by phone, you confirm that you have read, understood, and agree to these Terms and Conditions.

The user of the website must be at least 18 years old, or the legal age of majority in your jurisdiction, and must have the legal authority, right, and capacity to enter into a binding agreement under these Terms. You are not permitted to use this website or obtain services if prohibited by any law or regulation in your country or applicable to you.
The user of the website understands that the services offered on the website do not replace the treatment prescribed by a doctor and, if necessary, consults his own doctor.

When purchasing a product/service, you agree that:

(i) you are responsible for reading the product/service description before committing to the purchase;

(ii) you enter into a legally binding contract for the purchase of goods/services upon completing the purchase and payment process (including paying in cash).
(iii) you are responsible for being aware of your own personal liability when using the Services.

Sales Terms

Kairi Carine Saarts website (hereinafter Website and/or Online store and/or e-store and/or Gallery) is owned by OÜ Happy Happy OÜ (registration code 16101387, not a VAT litigant), registered address Kirilase 8, Tallinn, Estonia 11913.

VALIDITY OF THE SALES AGREEMENT, PRODUCT AND PRICE INFORMATION

1. The terms of sale apply to the purchase of services/products from the Website, including the booking of services.

2. The prices of the products and services sold on the website are indicated next to the products and services. If the price includes a fee for delivering the goods, it is indicated in the product information. Prices are in euros and do not include VAT. The seller has the right to change prices and make special offers.

4. The fee for delivering the goods depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when completing the order. If, in accordance with the laws of the delivery country, additional fees are added due to customs or taxes, here they are paid by the Buyer directly to the relevant authorities.

5. Information about the product or service is presented in the Webshop directly next to the product or service.

6. If the ordered goods cannot be delivered due to the end of the goods or for some other reason, the buyer will be informed of this as soon as possible and the money paid (including the costs of delivering the goods) will be returned without delay, but no later than within 14 days of sending the notice.

7. If the ordered service cannot be provided, the customer will be offered another time or the paid money will be returned immediately, but no later than within 14 days after the service was booked.

ART SALES TERMS

Ownership of Artwork: When you purchase artwork from Kairi Carine Saarts, you receive ownership of the physical piece. However, all intellectual property rights, including the right to reproduce, distribute, or publicly display the artwork, remain with the artist, Kairi Carine Saarts.

Reproduction Rights: The purchase of the artwork does not include the right to reproduce or create derivative works based on the artwork. Kairi Carine Saarts retains all copyrights and reproduction rights unless otherwise agreed in writing.

Personal Use Only: The buyer may display the artwork for personal use but may not copy, modify, sell, or distribute the artwork without prior permission from Kairi Carine Saarts.

E-STORE PURCHASE PROCESS

1. The customer selects a Product in the e-store and adds it to the shopping cart by pressing the "Add to cart" button.

2. To place the order, press the "Checkout" button in the shopping cart, after which the Customer will be forwarded to the order fulfillment page. After entering the required data, the Customer pays for the Product with a credit/debit card (offered by Stripe.com) or via Estonian bank links (offered by MakeCommerce or Maksekeskus).

3. After paying for the Product, the online store sends an order confirmation to the Customer's e-mail.

4. When completing the order, the customer must make sure that he has entered the correct order data.

5. The Seller is not responsible for the impossibility of performance due to incorrect data provided by the Customer or for the resulting consequences.

PRODUCTS

1. The products displayed in the e-shop are available in stock or marked with the possibility of pre-order. The availability of said Products may be faulty due to possible technical problems in the online store programs.

2. If the Customer places an order, but it appears that the given Product is out of stock, the online store will not be able to fulfill the given order. In this case, the Seller contacts the Customer and offers a replacement product, a possible new delivery time, or returns the purchase amount to the Customer within 3 days at the latest.

3. Photos of the Products displayed in the e-shop are illustrative and may unintentionally differ slightly from the actual appearance of the Product.

PAYMENT METHODS

Payment by credit/debit card.

Credit and debit card payments are mediated by the payment brokerage platform Stripe (stripe.com). Stripe's payment brokerage platform is one of the most popular and secure platforms in the world.

You can pay by entering your bank card number, name on the bank card and card security code. Card data can be stored for future use. All payment data are securely protected, as the website manager, the Online Store does not have access to them.

You can pay with both a debit card and a credit card.​

BUY NOW, PAY LATER: Inbank pay in three installments, pay next month or Inbank installments.

Payments are mediated by Maksekeskus AS. Payment takes place outside the Webshop in a secure environment - when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in the secure environment of Maksekeskus AS. The seller does not have access to the customer's bank and credit card data. ​

Happy Happy OÜ is the responsible processor of personal data and forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

CANCELLATION OF SERVICE

Event tickets are non-refundable and non-cancellable. ​

If you wish to change the time of the private session, please contact us via e-mail kairicarinesaarts@gmail.com, canceling or changing later than 24 hours before the start of the service, the service fee is not 100% refundable.

WITHDRAWAL

1. You have the right to exchange or return the ordered product within 14 days. The 14-day period starts from the moment you receive the product.

2. To withdraw, it is necessary for the Customer to send a withdrawal statement to the e-mail address kairicarinesaarts@gmail.com.

3. When returning goods, the principle applies that the return takes place in the same way as the goods were handed over to the buyer.

4. The Seller is not obliged to compensate the Customer for the transport costs related to the return.

5. The Seller transfers the returned Product/Products together with the delivery costs incurred by the Customer back to the Customer's bank account within 14 days of receiving the withdrawal statement. The customer is obliged to hand over the returned goods to the seller within 14 days of sending the withdrawal statement. The e-store may refuse to issue a refund until the returned product(s) have been returned or until the buyer has provided proof of return, whichever occurs first. The product to be returned must not be used, damaged, dirty or with other signs of use. The product must be complete (include the product packaging and all items included in the product packaging - user manual, certificate, etc.).

6. If the goods have been used for a purpose other than that of verifying the nature, properties and functioning of the goods, or if they show signs of use or wear, the e-shop has the right to reduce the returnable fee according to the decrease in the value of the goods.

CLAIMS

1. Products sold in the online store are subject to the 2-year claim submission deadline provided for in § 218 subsection 2 of the Tax Code. Disagreements between the customer and the seller are resolved through negotiations.

2. The customer has the right to contact the online store by sending an e-mail to kairicarinesaarts@gmail.com within two months at the latest after defects have appeared.

3. If the goods purchased from the e-store have defects for which the Seller is responsible, the Seller will repair or replace the defective goods. If it is not possible to repair or replace the goods, the Seller will return all fees included in the sales contract to the buyer.

4. The seller responds to the consumer's claims as soon as possible, but no later than within 15 days of receiving the claim.

5. According to § 222 subsection 1 of the Law of Obligations Act, the Customer has the right to demand repair or replacement of the Product if the Product does not meet the contract conditions. In the event of non-compliance of the Product with the contract conditions, the costs related to the repair of the Product or the replacement of the Product, in particular transport, postal, labor, travel and material costs, shall be borne by the Seller.

6. The Seller is not responsible for damages caused by the non-intended use of the ordered products, as well as for delays in delivery, if this is due to circumstances beyond the Seller's control and/or force majeure beyond his control.

RESPONSIBILITY

1. The seller and the customer are mutually responsible for damages caused by breaches of these terms of use, in accordance with the laws of the Republic of Estonia.

2. The seller’s liability is limited to the sale price of the product.

3. The customer agrees to use the online store services only for lawful and appropriate purposes.

TERMS AND CONDITIONS MODIFICATION

1. By registering in the online store or making a purchase, the customer agrees to these terms of use and undertakes to comply with them.

2. The sales contract between the seller and the customer comes into effect when the seller receives payment for the purchase.

3. The seller may change the terms of use and product prices at any time without notice. Notifications of changes will be published in the e-store. The prices and conditions visible to the customer at the time of the transaction will apply to that transaction.

4. The seller reserves the right to cancel an order if the product price displayed in the e-store was incorrect due to a technical error.

DIRECT MARKETING AND PERSONAL DATA PROCESSING

a. The website uses personal data provided by the buyer only to process orders and deliver goods. Personal data may be shared with transport companies for delivery purposes.
b. The website sends newsletters and offers to the buyer’s email only if the buyer has subscribed by entering their email and opting in to receive such communications.
c. By registering as a user, you can manage your preferences for receiving notifications in your profile.
d. The buyer can unsubscribe from offers and newsletters at any time by notifying us via email or following the unsubscribe link in the email.

RESOLUTION OF DISPUTES

If you have any complaints regarding the online store, please send them by email to kairicarinesaarts@gmail.com.

If a dispute cannot be resolved by agreement between the buyer and the online store, the buyer may appeal to the Consumer Disputes Committee. The committee resolves disputes arising from contracts between buyers and the online store, and the review of the buyer’s complaint is free of charge.

The buyer may also use the European Union's online dispute resolution platform.

Shipping & Returns

You can order from the Kairi Carine Saarts e-shop all over the world.

When ordering, please enter your address where we will ship the order. Select a DESTINATION COUNTRY to calculate the shipping fee.

If, in accordance with the laws of the delivery country, additional fees are added due to customs or taxes, here they are paid by the Buyer directly to the relevant authorities.

The seller is not responsible for delays and misunderstandings in the delivery of products, if the delay or misunderstanding is due to the inaccuracy or incorrectness of the data provided by the customer when placing the order.

1. General Provisions

These privacy terms govern the principles of collecting, processing, and storing personal data. Personal data is collected, processed, and stored by the data controller Happy Happy OÜ (hereinafter referred to as the "Data Controller").
a. A data subject, as defined by these privacy terms, is a customer or any other natural person whose personal data is processed by the Data Controller.
b. A customer, as defined by these privacy terms, is anyone who purchases goods or services from the Data Controller’s website.
c. The Data Controller follows the principles of data processing as set out in legal acts, including processing personal data lawfully, fairly, and securely. The Data Controller confirms that personal data has been processed in accordance with legal provisions.

These data protection terms have been drawn up in accordance with the European Parliament and Council Regulation (EU) No 2016/679 on the protection of natural persons concerning the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the Personal Data Protection Act of the Republic of Estonia, and other applicable Estonian and EU legislation.

2.What types of information do we collect?

Personal data collected, processed, and stored by the Data Controller is primarily gathered electronically through the website and email. We receive, collect, and store any information you enter on our website or provide to us in any other way.
a. By sharing personal data, the data subject grants the Data Controller the right to collect, organize, use, and manage personal data for the purposes defined in the privacy policy. This includes any data directly or indirectly provided when purchasing goods or services through the website.

  • We may use software tools to measure and collect session information, including page response times, visit durations for certain pages, page interaction information, and methods used to leave the page.

  • Additionally, we collect identifiable information (including name, email address, password, and communication), payment information (including credit card information), comments, feedback, product reviews, recommendations, and personal profiles.

3. Why do we collect and store personal data for a long time?

a. To provide and manage orders, we store data for up to seven years after making a purchase.

b. To provide customer assistance, customer management and technical support, we store data for up to seven years after making a purchase.

c. To comply with applicable laws and regulations, including financial activities and accounting. we keep the data for 7 years after the last transaction.

d. In order to be able to contact our visitors and users with general or personalized service-related notices and advertising messages, we retain until the data subject expresses a wish to stop receiving the information.

 

Our company is hosted on the Wix.com platform. Wix.com provides us with an online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com's data storage, databases, and general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by our company meet the standards established by PCI-DSS, which is administered by the PCI Security Standards Council, a collaborative effort of brands such as Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card data by our store and its service providers.

The data processor stores the data of the data subjects depending on the purpose of the processing, but not longer than 10 years.

4. Who do we share personal data with?

a. The data processor has the right to share customers' personal data with third parties, such as authorized data processors, accountants, transport and courier companies, companies providing transfer services. The data processor is the responsible processor of personal data.

The data processor transmits the personal data necessary for making payments to the authorized processor Maksekeskus AS and the payment intermediary platform Stripe.com.

b. When processing and storing the personal data of the data subject, the data processor implements organizational and technical measures that ensure the protection of personal data against accidental or illegal destruction, modification, disclosure and any other illegal processing.

5. What are the rights of the data subject?

a. The data subject has the right to get access to his personal data and to consult them.

b. The data subject has the right to receive information about the processing of his personal data.

c. The data subject has the right to supplement or correct inaccurate data.

d. If the data processor processes the data subject's personal data on the basis of the data subject's consent, the data subject has the right to withdraw the consent at any time.

f. The data subject can file a complaint with the Data Protection Inspectorate to protect his rights.
